What is the legal age of consent in Thailand?

  • What is the legal age of consent in Thailand?

    I've read it is 15. Isn't that pretty low? What is the drinking age? Age to work in bars. Have you seen incidences of pedophilia in Thailand? I haven't and have never been offered it. Here's an interesting article about this in Pattaya, of all places.

    A report has highlighted the vulnerability of children falling prey to Pedophiles in Pattaya. I look at the sexual abuse cases to date.




    This is serious problem. I was hijacked by the US Homeland Security Customs last December. They accused me of being such and overturned my luggage three times and made a huge mess. They were angry they couldn't find any evidence of smuggling, drugs, or anything. All they found was sex toys and 6 packs of Kamagra. Hahaha! Then they confiscated all of my cameras, SD cards, and laptop. After three weeks they found nothing. Everything was returned and no apology was given. After talking to friends they asked, "What was the PROBABLE CAUSE?" Actually there was none. They just made up a lie accusing me of Pedophilia. This failure to show PROBABLE CAUSE becomes a case for violation of my fourth Amendment rights against illegal search and seizure. I have written to both my Congressmen and Senators, and it's been just less than a month ago. So still waiting. I have written to the Department of Justice in Honolulu and sent them the same letters I sent to Congress. I hope they will take me seriously as a law-abiding doctor with absolutely NO history of criminality or being on any Sex Offender List. Funny how I scolded the two men who delivered my possessions to my house. I kept asking the same question in a variety of words. They kept saying I did nothing wrong and that they were just doing their jobs. Finally the schmuck who wouldn't take off his mafia sunglasses blurted out that prositiution is illegal in Thailand. I asked out loud whether the USA has any jurisdiction in Thailand twice before he answered no. but he had to have the last word and said, "Even though we found no pedophiia in your SD cards or laptop, that still doesn't mean you are not a pedophil. We just couldn't find any." Just what I needed to write in my letters. I am preparing myself for a Federal court battle for my civil rights.

    So be aware Thailand is a hotbed of PEDOPHILIA. I didn't even know that. I don't like pedophilia and neither do I hate it. I just simply never thought about it. I vacationed last winter for 60 days because I love the food, shopping, sightseeing, and the friendly people who love to smile. Of course the night life is so plentiful and cheap. What's not to like. I will say this in court if need be. Be sharp and ask to see their ID's when you meet the hospitality folks in bars. If you got a foreign passport or ID from Cambodia, Myanmar, or elsewhere, drop it and get away. Foreigners are NOT allowed to work in Thailand. Read the birthdate carefully. I just add the number of years to 2000 to 17, and you get the age. Sure is hard to tell if it is their own ID as their male pictures do NOT match their faces for the most part. I always take a picture of their ID's with my point and shoot camera. Upon reviewing my photos I discovered the youngest was 19 and the oldest was 43. Sure would have liked to look at the HSC officials faces when they saw the numerous photos of their blue ID's with their birth dates. Good thing I took all of them. For all of you my fellow travelers I advise you to be very aware of bar owners who will solicit you for child sex. Be suspicious of their ages. I did see one LB who was 17, and just took two pictures on Soi 7 for the record. The girls working in that same bar were promoting him. So that's when I had to ask what the Thai age of consent is. Can you tell me?

    The age of consent in Thailand is 15 regardless of gender or sexual orientation, as specified by article 279 of the Thai Criminal Code. The current legislation applies to all regardless of gender or sexual orientation.

    However,parts of the Prevention and Suppression of Prostitution Act, which disallow any sexual contact with prostitutes under the age of 18, are widely interpreted by some local authorities to cover sexual acts classed as "obscenity for personal gratification". Also, from the Penal Code Amendment Actof 1997 Section 283bis, having sex with an adolescent under 18 is a compoundable offense even with the consent of that person. The parent or the adolescent may file charges against the other side if they later regrets their own action. This ostensibly makes the Thai unfettered age of consent 18.

    I think that this would suggest that having sex with any girl or boy, who is under the age of 18, is a punishable offense even if they are prostitutes. I believe the age of consent being 15 may be referring to contracts and being able to make legal decisions on your own.

      Easyguy is correct - for non-pay for play consensual sex the legal age is 15 - however, when you are paying for it (and it doesn't just have to be cash, gifts, etc), 18 is the legal age. It is a common practice that lbs under 18 work in some of the bars. If you have the slightest suspicion your preferred lb is under 18, don't bother, as it could land you in tons of trouble.

        I don't know if 15 is the age of consent for everyone. If it is like Canada a 15 year old could only have consensual sex with someone 18 or under.
        Or there is some maximum age difference for those under 18 and over 14 such as 3 years. So a 17 year old could date a 15-17 year old.
        However a 21 year old cannot go with anyone under 18.

        Now not sure if the low 15 year old age has something to do with the rural and tribal cultures often taking younger wives.
        Many ladyboys were told me their virginity was taken by a much older man when they were very young.
        Might be borderline illegal but it seems that older men are initiating many ladies and ladyboys in Thailand.
        Perhaps this happens everywhere but we tend to look past it.

        However I think as a US citizen you are bound to the age of consent in your own country.
        The US has no jurisdiction over prostitution there but they can try to charge you for under age.
        As far as the bar system in Thailand goes, it is pretty hard to call it prostitution in the same way as the USA anyway.
        Thailand you don't often discuss money up front and it is more like a pick up where you just happen to give them money in the end
        Police in Thailand do not seem to consider bar work a crime. Just the street freelancers seem to fall into that category.

        Also they changed the laws in Thailand about 10 years ago so that nobody under 20 can work in a bar.
        Occasionally they raid bars and charge them with prostitution but I am not exactly clear on the criteria they use.
        I know it is often lady bars that are involved with human trafficking. Also i think short time rooms are supposed to distinctly separate from bars.

          Guess which President made that law against pedophilia in foreign countries making it a prosecutable offense. Remember President BJ? Impeached on national television. Last winter the Pattaya streetwalkers were almost nowhere to be found. They told me the fine increased from B100 to B1000. Puts a real damper on their livelihood. Funny one ladyboy's ID showed she was 19 and working in a bar. Violation there but the bar let her work. Across the Soi 7 street there was a bar with a group of cheerful girls telling me they have a new ladyboy, and she/he was 17 years old! I just took some pictures for the record and walked away thinking that this might be illegal. Wonder if there's a black market for fake ID's. Shouldn't be hard to photocopy and photoshop them. At my age everybody looks small and young in Asia. So take my advice. Take pictures of their ID's with a point-and-shoot camera at the well-lighted front desk and calculate the ages before you go up the elevator. Could make the difference between a court charge for PEDOPHILIA just because they look young. Porn is full of young girls who look surprisingly youthful. Be prepared to be asked questions if you visit Chiangmai and Cambodia. Maybe even Malaysia, Philippines, and Singapore.

            I think that this unequivocally is as clear as daylight. It is against the law in Thailand to have sex with anyone under 18, outside marriage, period. Buyer's beware or buyer's remorse. If anyone wants to make excuses or challenge the law, go for it.

              Same in the USA. That's why I don't do it. But Homeland Security wants to believe anybody who travels to Thailand does it.

                That is not what section 283bis says at all.
                This section refers to the offense of "taking a child away" without their consent..
                (I assume this means abduction or kidnapping)

                The same penalties are assessed if they commit rape or lewd behavior.
                The are sentenced differently if the age of the victim is below 15, below 18 or over 18.
                This is not referring to consensual sex specifically, just non-consensual acts.

                No where in that document does it say that the age of consent is 18.
                I read the whole section on sexual offenses and searched it for "eighteen".
                It clearly says the age of consent is 15, then also mentions the age of 13 where the offense is even worse.
                Also it states you can engage in consensual sex without someone as young as 13 as long as they are your wife.

                If you have non-consensual sex with anyone of any age it is illegal.
                However you are sentenced differently if they are under 18 or 15.

                As said previously you should be consider the age of consent in your own country as many countries have extended sex laws like this outside of their country, like the USA.
                Like I say most places have leniency for teenagers close in age having sex, you just can't stop nature completely. (like a 14 year old dating a 16 year old)

                Still the age of consent is meant for locals that live in Thailand. As many parts of law it may be up to the discretion of the judge or police in the situation.
                Things that happen in a rural village may not be found acceptable in Bangkok. It seems to be ok to marry a 13 year old but this may not hold throughout the country.

                It only mentions girls and women and children, it never mentions men or boys.
                It also says prostitutes can face life imprisonment. Girls working in bars almost never are charged and ones on the streets usually just get small fines.

                  I think I'll visit the Pattaya Police Station and ask the horse (the Chief) themselves. Bet you they don't know for sure. Real disorganized corrupt country. they can hide their lack of knowledge and make up their own laws to put you in jail. Then they yell at you and scare you into paying a large fine before they let you go. It's like someone who shoves a gun into your throat and steals your watch. Tourists are a plentiful source of money especially during hard times.

                    Just found this photo set on this very website. You tell me if he/she is underage and can get me arrested?



                    Better take pictures of her ID! Would be nice if you can ask the hotel staff to spot you and advise you whether your guest is dangerous. I suspect most of the perps were drunk and unable to make wise decisions.

                      You could go through many ladyboy websites and find young looking ladyboys like this.
                      True Obsessions is full of ladyboys who look like this and all are legal or have proper documents.

                        Section 282 says it all. To procure means to pay for. Simply put, paying for sexual services of anyone under 18 has harsh penalties. The penalties are even worse if someone is under 15. We all pay for sex when we go with a prostitute. We all have to realize what penalties can be lodged against us especially if that prostitute is under the age of 15.

                          Right in the commission of a crime.
                          The penalty is different if they are under 15, under 18 or over 18.
                          Any sexual crime is sentenced based on this.
                          Paying for sex is illegal no matter what the age, this has nothing to do with the age of consent in Thailand.
                          It is "always" illegal to pay for sex with ANYONE in Thailand.

                          It specifically says the legal age of consensual sex is over 15.
                          If the person is not prostituted, coerced, raped or physcially forced it is not illegal.
                          18 is just an limit for additional punishment.

                          Like I say, I am not promoting anything, just stating the facts.
                          Get the old experienced ones as far as i'm concerned.

                            So, if you go to Pratunam and meet a 15 year old LB or GG. She agrees to have sex. No payment is involved. Then you're within the legality of the Thai criminal code? I am wondering, when you take a LB or GG out of a bar or meet her on the street, take her back to your place, have sex and pay her after, how can the police prove you paid for sex unless she turns you into the police? Do they have undercover police working as prostitutes as they sometimes do in the west? I'm sure that nobody really worries much about getting caught in Thailand. However, it's always good to be cautious.

                              Reading behind the lines of any law is the idea of what is reasonable, given the stated law.
                              I think they would find anyone much older than a few years, guilty of some type of coercion of a minor or something.
                              It is just not reasonable that someone that young would go with an old person willingly.
