You say:-

Am I right in thinking the when you say same country  -  you mean that they must both be citizens of your country.

As Rxpharm says you may be able to try to get citizenship of your country for your Thai gf.
Have you tried looking at that option.


The only course of action I can think of would be to get married in Spain and then return to your own country and make a legal challenge to the law in your own country.

I believe (but you will have to take proper legal advice) that you may be able to challenge this law in the European Court of Human Rights.


Either way this could be a slow and expensive process!

Hello Naang Faa,

I guess your 'significant other half' to be is Thai.

That being the case there is NO provision for a Thai citizen to change their sex.

So she will be male and you will be female.

Therefore under English law (not sure about Scotland  -  as the guys wear skirts    )  your marriage will not be same sex.

they are checking my case for FIRST TIME in this small f***ing European country which follows the French code ... accepts gays to be together BUT only if they are from the same country... Allows marriages but not of the same sex... so my GF and I live in the TWILIGHT zone... it seems to be their first TRANSSEXUAL CASE and then people say we live in the 21st century

It seems they have never before had a case like mine BUT they said they will have a look at it ... that means time and money for me and the possibility to lose my gf when she goes back to thailand (smart birds are everywhere)

ANYWAY ... thanks for the help I think I need a lawyer RIGHT in the moment I do not money to waste...

I am European BUT in my country they do not recognize at all gay marriages...(old fashioned small European country).

Citizens means to live in the same country, i.e. the country where I currently live. I may be trying for FIANCE visa later on this year BUT it will be far too dificult since they do to even want to see me (called me gay) at the visa offices. I am for first time of my life in Deep Shit ... Let's see how it goes OR I may need to change country again like I did last year from Thailand Here

Just re read all the posts - sounds like you have a lot of advice and support.
Is your country in the EU states? If so a marriage within the EU states must be recognised by other EU states. An English friend of mine married a Thai lady (GG) in France - the UK had to accept their marriage.
Good luck - please keep the forum posted on progress and the outcome.
